Terms of Service for Scribular

These Terms of Service ("Terms") govern your use of the Scribular desktop application ("Application") created by Patrick Gallagher ("Service Provider"). By downloading, installing, or using the Application, you agree to these Terms. Please read them carefully.
1. License and Use
Scribular is provided to you as a paid commercial service. When you purchase or download the Application, you are granted a limited, non-transferable, non-exclusive license to use it on your personal computer, solely for your own use and in accordance with these Terms.
You may not:
- Copy, modify, or distribute the Application or any part of it.
- Reverse engineer, decompile, or attempt to extract the source code.
- Create derivative works based on the Application.
- Use Scribular for unlawful or harmful purposes.
All rights not expressly granted remain with the Service Provider.
2. Intended Use and Disclaimers
Intended Use
Scribular is intended as a general-purpose documentation aid for professionals. It is not intended for use in diagnosing, curing, mitigating, treating, or preventing any disease or condition, and should not be relied upon to inform clinical decisions.
User Responsibility
Users are responsible for reviewing and verifying all AI-generated summaries. Scribular makes no guarantees as to the accuracy or completeness of its outputs. Any errors must be corrected by the user prior to clinical use. Scribular is not responsible for any decisions made based on its generated content.
Risk Disclosure
Large Language Model (LLM) systems, like the one used in this application, can occasionally misinterpret or hallucinate information. Use of this application is at the user's discretion, and summaries should be considered drafts requiring review.
Protected Health Information Disclaimer
Scribular may be used to process Protected Health Information (PHI) locally on the user’s device, however no session content or PHI is stored, transmitted, or accessible to the Service Provider. As a result, Scribular is not designated nor required to be a HIPAA covered entity. Users are solely responsible for complying with applicable privacy laws and professional guidelines (eg. keeping your computer up-to-date with security updates, and never sharing your computer's password).
3. Ownership and Intellectual Property
All trademarks, logos, copyrights, and other intellectual property associated with Scribular remain the property of the Service Provider. You may not use these assets without express written permission.
4. Data and Privacy
Scribular is a privacy-first local desktop application. All session content is both processed and stored on your own device until you delete it. We are committed to setting an example for others to achieve the highest level for privacy possible using the latest advances in technology.
The only data we may collect is:
- A periodic signal from the app to verify your subscription status.
- Basic usage statistics. (eg. number of sessions per week and average length of sessions).
- Your email address (used only for billing or customer support).
- Web cookies on Scribular.com, for marketing purposes.

5. System Requirements and Updates
Scribular is designed to run on supported desktop operating systems. You are responsible for ensuring your system meets the necessary requirements and remains updated.
From time to time, updates may be released to improve functionality or ensure security. You agree to install updates when they become available. Failure to update may result in loss of functionality or service. This is necessary to ensure the application is running on a computer with the necessary security updates.
6. Third-Party Services
Scribular does not use third-party services within the application itself. However, our website may use external services such as:
- Vercel or other analytics tools
These services have their own terms of use, which you should review when interacting with the Scribular website.
7. Service Modifications and Termination
The Service Provider reserves the right to modify or discontinue Scribular at any time without prior notice. This includes changes to pricing, features, or availability.
If the application is discontinued:
- Your license to use Scribular will terminate
- Your continued usage of the application is at your own risk. We cannot make any guarantees of privacy or security.
- No further support or updates will be provided.
8. Limitation of Liability
Scribular is provided "as is" without warranties of any kind. While we strive to ensure a reliable and secure experience, we cannot guarantee that the Application will always function as intended or be free of errors.
The Service Provider is not liable for any indirect, incidental, or consequential damages that result from your use (or inability to use) the Application, including but not limited to loss of data, business interruption, or professional liability.
9. Changes to These Terms
These Terms may be updated from time to time. You are encouraged to review them periodically. Continued use of the Application after changes are posted constitutes your acceptance of the new Terms.
